These Terms of Service (“Terms”) govern your use of the Clear Touch closeout store and related services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services or place an order with Clear Touch.

Account Registration

If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at info@getcleartouch.com if you believe your account has been compromised.

About This Store

This store sells closeout, open-box, used, and replacement-part inventory. Condition is stated on each product listing. Closeout and used units are sold as-is except as set out in our Return & Refund Policy.

Certain replacement parts are available by direct link only and are not listed in store search or browsing. Installing internal components may affect your warranty coverage; contact our support team before ordering service parts.

Products and Pricing

  • Product descriptions, images, and specifications are provided for reference. Colors, finishes, and dimensions may vary slightly from what is displayed, and used units may show cosmetic wear.
  • All prices are listed in U.S. dollars and are subject to change without notice. Pricing errors may be corrected at Clear Touch's discretion before or after an order is placed.
  • Availability is subject to change. Closeout inventory is limited and often one-of-a-kind. We reserve the right to limit order quantities or refuse orders at our discretion.

Orders and Payment

Placing an order is an offer to purchase. Clear Touch reserves the right to accept or decline any order. Payment is processed through Shopify's payment gateway or another authorized processor. You represent that you are authorized to use the payment method submitted.

Shipping, Returns, and Warranty

The following policies are incorporated into these Terms by reference:

  • Shipping Policy — how and where we ship.
  • Return & Refund Policy — return windows, restocking fees, and refund terms.

Products sold through this store carry the standard Clear Touch warranty unless the product listing states otherwise. Warranty terms are provided with the product and are available from our support team on request.

Intellectual Property

All content on the Services — including the Clear Touch name, logo, product designs, text, graphics, and software — is the property of Clear Touch or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, modify, or distribute any content without prior written permission.

Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Services, other accounts, or our systems.
  • Interfere with or disrupt the Services or the servers and networks that support them.
  • Use automated tools (bots, scrapers) to access the Services without our written permission.
  • Submit false, misleading, or fraudulent information.

Disclaimer of Warranties

Except as expressly stated in the warranty provided with your product, the Services and all products are provided “as is” and “as available” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Clear Touch's total liability arising out of or related to these Terms or your use of the Services shall not exceed the amount you paid Clear Touch for the product giving rise to the claim. Clear Touch shall not be liable for any indirect, incidental, consequential, or punitive damages.

Indemnification

You agree to indemnify and hold harmless Clear Touch and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Services or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Services shall be brought exclusively in the state or federal courts located in Greenville County, South Carolina.

Changes to These Terms

We may update these Terms from time to time. Updates take effect upon posting. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
